2. Purpose

Bluekind HoldCo SL is a holding company that creates long-term value across two strategic areas: independent advisory on AI-native software engineering, covering the adoption of AI coding agents across the software development lifecycle, and investment in early-stage technology companies.

3. Conditions of Use

Access to and use of this website implies acceptance of these general conditions. The user agrees to make appropriate use of the content and services offered through this website and not to use them for:

Engaging in illegal, harmful, or contrary to public order and good faith activities
Disseminating content or propaganda of a racist, xenophobic, pornographic, terrorist, or contrary to human rights nature
Causing damage to physical and logical systems of Bluekind HoldCo SL, its suppliers, or third parties
Introducing or disseminating computer viruses or any other physical or logical systems that may cause damage
Attempting to access and use the email accounts of other users and modify or manipulate their messages

Bluekind HoldCo SL has adopted the necessary technical and organizational security measures to ensure the security of personal data and prevent its alteration, loss, unauthorized processing or access, taking into account the state of technology, the nature of the data stored, and the risks to which they are exposed.

5. Personal Data Processing

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data (GDPR), and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD), we inform you that:

What we process, why, and on what legal basis.

Answering your message. The contact form asks for your email address and your message. We use them to reply to you and to keep the resulting business correspondence. Legal basis: your consent, given when you submit the form.
Measuring audience. Data collected by Google Analytics as described in clause 7. Legal basis: your consent, which we ask for before any analytics cookie is written and which you can withdraw at any time in that same clause.
Serving the website and keeping it secure. Your IP address and technical request data are recorded by our hosting provider. Legal basis: our legitimate interest in operating the site and preventing abuse.

Processors and recipients. We do not sell or rent personal data, and we disclose it to no one beyond the providers we need in order to run this website, plus any disclosure required by law. Those providers are:

Formspree Inc. (United States): receives and delivers the contact form submissions.
Google LLC and Google Ireland Limited: Firebase Hosting serves this website, Google Analytics measures audience, and Google Fonts serves the typefaces. Because the typefaces are loaded from Google servers, your IP address reaches Google when the page loads, whether or not you accept cookies.
Volentio JSD Limited (jsDelivr): serves a JavaScript library from its content delivery network, so your IP address reaches that network when the page loads.

International transfers. Formspree and Google are established in the United States. These transfers rely on the European Commission adequacy decision for the EU-US Data Privacy Framework and, where that decision does not apply, on the European Commission standard contractual clauses.

Retention. We keep the messages you send us for as long as we are dealing with your enquiry and, afterwards, for as long as any legal obligation or possible claim requires. Server logs and analytics data are kept for the retention periods configured with the providers named above.

Your rights. You may request access to your data, its rectification or erasure, the restriction of its processing, its portability, and you may object to processing based on our legitimate interest. Where processing is based on consent, you may withdraw it at any time, without affecting the lawfulness of the processing carried out before the withdrawal: for cookies you can do this yourself in clause 7, and for anything else by writing to info@bluekindholdco.com. You may also lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

6. Intellectual and Industrial Property

All content on this website, including but not limited to texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as its graphic design and source codes, is the exclusive property of Bluekind HoldCo SL or its licensors, and is protected by national and international intellectual and industrial property laws.

Any reproduction, distribution, public communication, transformation, or any other act not expressly authorized by the owner of the exploitation rights is strictly prohibited.

7. Cookies

This website uses Google Analytics 4 to measure visits and pages read. Analytics cookies are not among those exempt from article 22.2 of Law 34/2002, so we ask for your consent before they are written. Until you accept, Google Analytics runs in consent mode with storage denied: it counts the visit without writing any cookie and without a browser identifier.

We use no advertising cookies, no conversion pixels and no profiling, and we sell no audiences. The three advertising signals of Consent Mode v2 are declared denied and stay denied. Measurement data is processed by Google LLC as our processor, and may involve international transfers covered by the EU-US Data Privacy Framework. These general conditions are governed by Spanish law. For the resolution of any dispute arising from access to or use of this website, Bluekind HoldCo SL and the user agree to submit to the courts and tribunals of Girona, Spain, expressly waiving any other jurisdiction that may correspond to them.
